AI Terms of Service
These AI Terms of Service (this "Agreement") are a binding contract between you ("Customer", "you", or "your") and Kidloom ("Provider", "we", or "us"). This Agreement governs your access to and use of the Services. The Services provided under this Agreement are for personal, family, or educational use, and not for commercial resale. This Agreement becomes effective when you first access, click "Log In", or use the Services ("Effective Date"). By accessing or using the Services, you (A) acknowledge that you have read and understand this Agreement; (B) represent and warrant that you have the right, power, and authority to enter into this Agreement; and (C) accept this Agreement on your own behalf and agree to be legally bound by its terms. If you do not accept these terms, you may not access or use the Services.
1. Definitions
"AI Customer Input" means all information, prompts, or images (including child photos or descriptions provided by parents) transmitted through the Service. "AI Customer Output" means the story text and illustration content generated by the Service in response to Inputs. "AI Technology" means the machine learning, models, and related generative technologies. "Customer Data" means AI Customer Input and AI Customer Output. "Provider Intellectual Property" means the Kidloom Service, documentation, and all related intellectual property rights, including modifications and improvements. "Confidential Information" means proprietary information disclosed by either party. Provider IP is our Confidential Information; Customer Data is your Confidential Information.
2. Access and Use
(a) Provision of Access: We grant you a non-exclusive, non-transferable right to access and use the Services for personal and family use in accordance with this Agreement. (b) Use Restrictions: You shall not (i) copy, modify, or create derivative works of the Service; (ii) reverse engineer, disassemble, copy training data, or perform model extraction; (iii) access the Service to develop or train competing AI technology; (iv) use crawlers or data extraction tools; (v) generate content that infringes on others' intellectual property or violates laws. (c) Aggregate Statistics: We may collect anonymized data related to your usage to improve service operations. Such data is the property of the Provider. (d) Suspension: If we detect security threats, fraudulent activity, or material breach of this Agreement, we may temporarily suspend your access ("Service Suspension").
3. Customer Responsibilities
(a) Acceptable Use: The Service shall not be used for illegal, fraudulent, offensive, or obscene activities. (b) Use of AI Output: You are solely responsible for evaluating the appropriateness, accuracy, and safety of AI Outputs before displaying them to children or distributing them. (c) Credential Security: You are responsible for maintaining the confidentiality of account passwords and access credentials and must immediately notify us of any unauthorized access.
4. Fees and Payment
A. Purchase: You warrant that you have the legal right to use the payment method. We reserve the right to refuse orders due to product description errors or suspected fraud. B. Subscription: Kidloom provides subscriptions on a recurring billing basis. You can cancel automatic renewal at any time before the end of the billing cycle. C. Fee Changes: We reserve the right to modify fees, with changes taking effect in the next billing cycle. D. Refund Policy: Due to the nature of AI virtual products and data processing costs, fees paid are generally non-refundable unless otherwise required by law.
5. IP Ownership; Feedback
(a) Provider IP: Kidloom owns all Provider Intellectual Property. For background technology and materials integrated into AI Outputs, we grant you a worldwide license to distribute and display to the extent necessary for your lawful use of those Outputs. (b) Customer Data: Between you and Provider, you own your Customer Data, subject to the license granted to us: you grant us a royalty-free license to use such data solely for the purpose of providing and improving the Service. (c) Feedback: Any suggestions you provide may be used by us freely without compensation.
6. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or special damages (including errors in AI-generated content) resulting from your use of the Service. Our total liability shall not exceed the amount paid by you in the past 12 months.
7. Confidentiality
The receiving party shall not disclose the disclosing party's Confidential Information to any third party, except to employees or agents who need to know to fulfill obligations under this Agreement. Confidentiality obligations survive termination for the statutory period.
